Republican AGs Sue Biden Administration Over Climate Policies

A coalition of 14 Republican attorneys general led by Missouri on Monday accused President Joe Biden in federal court of exceeding his powers over an executive order that restored Obama-era levels of the costs of climate change. While left-leaning articles highlight that Biden has not supported the Green New Deal resolution pushed by the progressive wing of Democrats in Congress, right-leaning articles highlight that the suit alleges that Biden’s order does not have the authority to issue binding numbers for the “social cost” of greenhouse gases to be used in federal regulations.

Reuters published a centrist article reporting that attorney general Eric Schmidt and his peers accused Biden of violating the U.S. Constitution’s separation of powers with Executive Order 13990, which re-ups the so-called “social cost of greenhouse gases.” While former President Trump had slashed that figure, Biden’s administration restored it to about $50 per ton of greenhouse gases in February.

A right-leaning article by Fox Business highlights that the suit alleges that Biden’s order does not have the authority to issue binding numbers for the “social cost” of greenhouse gases to be used in federal regulations. The suit claims that the action violates the separation of powers, “the most fundamental bulwark of liberty.”
