DOJ Sues Idaho Over Abortion Law

The Department of Justice (DOJ) has sued Idaho over an abortion law in its first test to defend reproductive rights since the Supreme Court’s June ruling in Dobbs. While left-leaning articles highlight the DOJ’s arguments, right-leaning articles highlight the Idaho law itself.

A left-leaning from Huffpost focuses on how the DOJ argues that Idaho’s abortion ban violates the 1986 Emergency Medical Treatment and Labor Act (EMTALA). The lawsuit accuses Idaho of making it a criminal offense for doctors to comply with EMTALA, a statute that mandates patients receive appropriate medical care in emergency situations. 

USA Today published a centrist article reporting on how Attorney General Merrick Garland has pledged to use “every tool at [his] disposal” to protect reproductive rights. Idaho Attorney General Larence Wasden, however, called the DOJ’s actions “a politically motivated lawsuit” and accused federal officials of never engaging Idaho state officials in meaningful discourse.

A right-leaning article from The Daily Caller focuses on how the Idaho law, a trigger law originally passed in 2010, will take effect on August 25th, preventing abortions unless in cases of rape and incest and if the mother can show proper documentation from authorities.
