Judge Delays Decision on Flynn Case

U.S. District Judge Emmet Sullivan said that he would delay an immediate decision on a Justice Department request to abandon the prosecution of former national security advisor Michael Flynn and set a schedule for outside parties to challenge the government’s position. While left-leaning articles highlight that Flynn’s legal team objected to the decision, right-leaning articles highlight that four or five batches of intelligence will be declassified regarding the “unmasking” of Michael Flynn.

 

A left-leaning article by The New York Times highlights that Flynn’s legal team immediately objected to Judge Sullivan’s decision, as they are likely worried that the judge was inviting a wide-ranging, public discussion of whether the Justice Department was inventing legal arguments in order to help one of the president’s allies. The article also gives background onto why Flynn’s case was thrown out, which stemmed from U.S. attorney in St. Louis Jeff Jenson’s claim that there was a series of mistakes and judgements by both F.B.I agents and prosecutors involved in Flynn’s case.

 

USA Today published a centrist article reporting that Flynn’s lawyers said that outside parties were “free to express their views” but there was no provision to join an ongoing criminal case. The article notes that Sullivan’s decision also raises the likelihood that the Justice Department would be required to present evidence to support its motion to dismiss.

 

New York Post published a right-leaning article highlighting that Acting Director of National Intelligence Richard Grenell is declassifying four or five other batches of intelligence along with the list of Obama administration officials who were allegedly involved in the “unmasking” of Michael Flynn. The intelligence includes information that could cause things to “get sticky” for former CIA Director John Brennan regarding what knowledge he had of Russia’s election interference in 2016.
