Transgender Health Protections Reversed by Trump Administration

On Friday, the Trump administration finalized a rule that would remove non-discrimination protections for LGBTQ people for health care and health insurance. While left-leaning articles highlight that the rule is part of a broad pattern of regulatory changes that establishes a definition of sex as being biologically determined at birth, right-leaning articles highlight that head of the Health and Human services Department unit that enforces civil rights laws said that transgender people will continue to be protected under other statues barring discrimination.

 

The New York Times published a left-leaning article highlighting that transgender rights advocates criticized the timing of the finalized rule for taking place in the middle of a pandemic. Katie M. Keaith, who teaches health law at Georgetown University, said the rule is part of a broad pattern of regulatory changes that eliminate civil rights protections for transgender people and establishes a definition of sex as being biologically determined at birth.

 

NPR published a centrist article reporting that the Trump administration said it was making the change to reduce confusion that sex means male or female, and that it’s saving around $3 billion by eliminating requirements to mail notices of non-discrimination protections. The article notes that it is likely that lawsuits will try to block the rule or put it on hold, just like many executive actions from the Trump administration.

 

A right-leaning article by Fox News highlights that Roger Severino, head of the Health and Human services Department unit that enforces civil rights laws, said that transgender people will continue to be protected under other statues barring discrimination. The article notes that in 2019, the Trump administration enacted a rule limiting transgender participation in the military.
