Trump Administration Claims DACA Program is Unlawful

On Tuesday the Trump administration told the Supreme Court that the Deferred Action for Childhood Arrivals (DACA) program needed to be terminated. DACA currently protects more than 660,000 immigrants from deportation and provides them work permits. Trump attempted to kill the program in 2017 but was blocked by lower courts.
A left-leaning article by The Washington Post reports that the Department of Homeland Security has a right to terminate DACA even if it is lawful. The article states that the court’s liberal justices claim the administration needs more compelling reasons for ending the program, while Solicitor General Noel Francisco said that Obama never saw the program as permanent and those who benefitted were on notice that they must reapply every two years.
A centrist article by Reuters reports that the Supreme Court’s 5-4 conservative majority, which includes two Trump appointees, indicated support for Trump’s action to kill the DACA program. The article also recalls Trump’s travel ban last year, which the Supreme Court upheld as lawful with the explanation that the president has broad discretion to implement such a policy.
A right-leaning article by The New York Post highlights Trump’s statements describing many of the immigrants dubbed “Dreamers” as “hardened criminals.” In appealing to his reasons for rescinding DACA, Trump said, “Before we ask what is fair to illegal immigrants, we must also ask what is fair to American families, students, taxpayers, and job seekers.”
